Conditions d'achat d'arbre

 1.   L’achat des arbres se fait dans la section Boutique de Carbone ForesTree. Quand l’achat sera complété, L’ACHETEUR recevra par courriel une confirmation d'achat. Dans un délai de 15 (Quinze) jours ouvrables, le nom et les informations de L’ACHETEUR ainsi que de ceux DU PROPRIÉTAIRE DE\DES ARBRES seront inscrits dans le  (REGISTRE DES ACHETEURS ET PROPRIÉTAIRES D’ARBRES). L’ACHETEUR recevra également par courriel un certificat de son ou de ses arbres incluant les informations suivantes :

• Le numéro de certificat
• Le nom de la plantation
• Les coordonnées GPS 
• Le nombre d’arbres achetés
• La date du certificat
• Le nom DU PROPRIÉTAIRE DE\DES ARBRES 
• Le nom de L’ACHETEUR

2..  Au moment de la production du certificat, c’est le nom DU PROPRIÉTAIRE DE\DES ARBRES écrit sur le certificat qui deviendra PROPRIÉTAIRE DE\DES ARBRES. Il est de la responsabilité DU PROPRIÉTAIRE DE\DES ARBRES de toujours transmettre ses nouvelles coordonnées AU PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) pour qu'il puisse inscrire les modifications dans le (REGISTRE DES ACHETEURS ET PROPRIÉTAIRES D’ARBRES).

3.       LE PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) conservera les documents de vente, le certificat ainsi que le  (REGISTRE DES ACHETEURS ET PROPRIÉTAIRES D’ARBRES). Les documents seront conservés en lieu sûr. 

1. LE PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) demeure propriétaire du terrain (partie inférieure) et LE PROPRIÉTAIRE DE\DES ARBRES devient propriétaire que DE\DES arbres (partie supérieure). Ce qui veut dire que quand la coupe complète de la plantation sera effectuée, ainsi que le produit de la vente du bois distribué à qui de droit, le contrat prendra fin entre LE PROPRIÉTAIRE DE\DES ARBRES et LE PROPRIÉTAIRE (VENDEUR GESTIONNAIRE). LE PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) reprendra tous ses droits de superficies de la propriété (partie supérieure du terrain) ainsi que sur les prochains arbres et productions à venir. 
2. LE PROPRIÉTAIRE DE\DES ARBRES ne peut décider de couper son ou ses arbres, c’est LE PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) qui a été mandaté par LE PROPRIÉTAIRE DE\DES ARBRES de prendre cette décision le moment venu. 
3. Si LE PROPRIÉTAIRE DE\DES ARBRES désire vendre son ou ses arbres, il devra en aviser LE PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) pour ensuite inscrire le transfert dans le REGISTRE DES ACHETEURS ET PROPRIÉTAIRES D’ARBRES. Cependant, en premier lieu, LE PROPRIÉTAIRE DE\DES ARBRES doit offrir AU PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) de racheter son ou ses arbres. LE PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) n’est pas tenu d’accepter le rachat de/ou de ses arbres).  

1. Pendant toute la durée de croissance des arbres de la plantation, les coûts reliés à l’achat, à la plantation des arbres, aux taxes foncières et à l'administration sont compris dans le prix que LE PROPRIÉTAIRE DE\DES ARBRES paie pour chaque arbre.  
2. Pendant toute la durée du contrat, LE PROPRIÉTAIRE DE\DES ARBRES cède AU PROPRIÉTAIRE (VENDEUR GESTIONNAIRE) tous ses droits sur la gestion de son ou de ses arbres ainsi que sur la gestion de la vente du produit de la coupe totale. 

  1. The purchase of trees is done in the Boutique section of Carbone ForesTree. When the purchase is completed, the BUYER will receive a purchase confirmation by email. Within 15 (Fifteen) working days, the name and information of THE PURCHASER and THE OWNER OF THE TREES will be entered in the (REGISTER OF BUYERS AND OWNERS OF TREES). The BUYER will also receive by email a certificate of his tree or his trees including the following information:

•  The certificate number

•  The name of the plantation

•  The GPS coordinates 

•  The number of trees purchased

•  The date of the certificate

•  The name OF THE OWNER OF THE TREES

•  The name of the BUYER

2.. At the time of production of the certificate, it is the name OF THE OWNER OF THE TREES written on the certificate which will become OWNER OF THE TREES. It is the responsibility of THE OWNER OF TREES to always send their new contact details TO THE OWNER (SELLER MANAGER) so he can record the changes in the (REGISTER OF BUYERS AND OWNERS OF TREES). 

3. THE OWNER (SELLER MANAGER) will keep the sales documents, the certificate as well as the (REGISTER OF BUYERS AND OWNERS OF TREES). The documents will be kept in a safe place.

1. THE OWNER (SELLER MANAGER) remains the owner of the land (lower part) and THE OWNER OF TREES becomes the owner of only his tree or only his trees (upper part). This means that when the complete cutting of the plantation is carried out, as well as the proceeds from the sale of the wood distributed to whom the right belongs, the contract will end between the OWNER OF TREES and the OWNER (SELLER MANAGER). THE OWNER (SELLER MANAGER) will take over all of his rights to the surface of the property (upper part of the land) as well as the next trees and productions to come. 
2. THE OWNER OF TREES cannot decide to cut his or her trees, it is THE OWNER (SELLER MANAGER) who has been mandated by THE OWNER OF TREES to make this decision when the time comes.
3. If THE OWNER OF TREES sells of his tree or his trees, he must notify THE OWNER (SELLER MANAGER) for him to register the transfer in the REGISTER OF TREE BUYERS AND OWNERS. However, first, THE OWNER OF TREES must offer THE OWNER (MANAGER SELLER) to buy back his tree(s). THE OWNER (MANAGER SELLER) is not required to accept the buyback of his tree or his trees.

1. For the duration of the growth of the trees of the plantation, the costs related to the purchase, planting of the trees, property taxes and administration are included in the price that THE OWNER OF TREES pays for each tree. 
2. Throughout the duration of the contract, THE OWNER OF TREES assigns to the OWNER (SELLER MANAGER) all his rights on the management of his tree(s) as well as on the management of the sale of the proceeds of the total cut.
